and insert:

(j) When an entity treated as a partnership or a
8
disregarded entity under this chapter produces and sells
9
electricity from a new or expanded renewable energy facility, the
10
credit earned by such entity shall pass through in the same
11
manner as items of income and expense pass through for federal
12
income tax purposes.

(k) A taxpayer's use of the credit granted pursuant to this
14
section does not reduce the amount of any credit available to
15
such taxpayer under s. 220.186.
16
Section 10. It is the intent of the Legislature that the
17
amendments made by this act to s. 220.193, Florida Statutes, are
18
remedial in nature and apply retroactively to the effective date
19
of the act establishing the credit.

31
tax credit; providing legislative intent that such
32
provisions apply retroactively to the effective date of the
33
act establishing the credit;
