(Saunders) recommended the following amendment to amendment

     Senate Amendment (with title amendment)

     Between lines 1967 and 1968,

insert:

8

     Section 30. Recycling.--

9

     (1) The Legislature finds that the failure or inability to

10

economically recover material and energy resources from solid

11

waste results in the unnecessary waste and depletion of natural

12

resources. Therefore, the maximum recycling and reuse of such

13

resources must be considered high-priority goals of this state.

14

     (2) The long-term goal for the reduction of solid waste by

15

recycling efforts undertaken by state government entities shall

16

be a reduction by 2020 of 75 percent of the amount of solid

17

waste that was disposed of by state government in 2007, not

18

including any recycling efforts undertaken during that year. The

19

Department of Environmental Protection shall, by 2010, develop a

20

recycling program, in conjunction with the state judicial and

21

legislative branches of government, which is designed to meet

22

that goal.

     (3) The-long term goal for the reduction of solid waste by

24

recycling efforts undertaken by municipal and county governments

25

shall be a reduction by 2020 of 75 percent the amount of solid

26

waste that was disposed of in 2007, not including any recycling

27

efforts undertaken during that year. Each county shall provide

28

to the department by 2010 a recycling program for that county,

29

including any municipalities, which is designed to meet that

30

goal.

     (4) A recycling grant program is established to aid local

32

communities in establishing, operating, or providing public

33

awareness for recycling efforts. The following factors shall be

34

considered, among others, when selecting recipients for the

35

recycling program grants:

36

     (a) The benefits to energy conservation and the

37

environment;

38

     (b) The availability of capacity at exiting solid waste

39

facilities; and

40

     (c) The level of commitment of local officials and the

41

level of volunteer and private-sector interest in the program.

To be eligible to receive a grant, a local community must commit

44

to a 50-percent local match to the amount awarded by the state.

45

The local recycling project must also be planned or underway,

46

and any education project must directly promote the use of that

47

project. Counties and municipalities are encouraged to form

48

interlocal agreements to pursue such recycling programs when

49

applying for grants.

(5) The implementation of the grant program is contingent

51

on the availability of appropriated funds.
