(Saunders) recommended the following amendment to amendment

4. The business project is located in this state; and

9

     5. The jobs created by the business project pay an

10

estimated annual average wage that equals at least 130 percent of

11

the average private sector wage. The average wage requirement

12

may be waived if the office and the commission determine that the

13

merits of the individual project or the specific circumstances

14

warrant such action; and

15

     6. The business project meets one of the following

16

criteria:

17

     a. Results in the creation of at least 35 direct, new jobs

18

at the business; or

19

     b. Has an activity or product that uses feedstock or other

20

raw materials grown or produced in this state; or

21

     c. Has a cumulative investment of at least $50 million

22

within a 5-year period.

d. The project shall address technical feasibility of the

24

technology, and the extent to which the proposed project has been

25

demonstrated to be technically feasible based on pilot project

26

demonstrations, laboratory testing, scientific modeling, or

27

engineering or chemical theory that supports the proposal.

28

     e. The project shall include innovative technology and the

29

degree to which the project or business incorporates an

30

innovative new technology or an innovative application of an

31

existing technology.

f. The project shall include production potential and the

33

degree to which a project or business generates thermal,

34

mechanical, or electrical energy by means of a renewable energy

35

resource that has substantial long-term production potential.

36

The project must, to the extent possible, quantify annual

37

production potential in megawatts or kilowatts.

38

g. The project shall include and address energy efficiency

39

and the degree to which a project demonstrates efficient use of

40

energy, water, and material resources.

41

h. The project shall include project management and the

42

ability of management to administer a complete the business

43

project.
