Section 21. Paragraph (j) of subsection (2) of section

377.703, Florida Statutes, is amended to read:

377.703 Additional functions of the Department of
12
Environmental Protection; energy emergency contingency plan;
13
federal and state conservation programs.--

(2) DEFINITIONS.--
15
(j) "Renewable energy resource" means electrical,
16
mechanical, or thermal energy produced from a method that uses
17
one or more of the following fuels or energy sources: hydrogen
18
produced from sources other than fossil fuels or nuclear energy,
19
solar energy, geothermal energy, wind energy, ocean energy,
20
waste heat, hydroelectric power, and biomass. As used in this
21
paragraph, "biomass" means a power source that is comprised of
22
combustible residues, oils or gases from forest products
23
manufacturing, agricultural and orchard crops, waste products
24
from livestock and poultry operations and food processing, urban
25
wood waste, biogenic municipal solid waste, municipal liquid
26
waste treatment operations, and landfill gas means any method,
27
process, or substance the use of which does not diminish its
28
availability or abundance, including, but not limited to,
29
biomass conversion, geothermal energy, solar energy, wind
30
energy, wood fuels derived from waste, ocean thermal gradient
31
power, hydroelectric power, and fuels derived from agricultural
32
products.

Section 22. Subsection (6) of section 377.803, Florida
34
Statutes, is amended to read:

377.803 Definitions.--As used in ss. 377.801-377.806, the
36
term:

(6) "Renewable energy" means electrical, mechanical, or
38
thermal energy produced from a method that uses one or more of
39
the following fuels or energy sources: hydrogen produced from
40
sources other than fossil fuels or nuclear energy, solar energy,
41
geothermal energy, wind energy, ocean energy, waste heat,
42
hydroelectric power, and biomass. As used in this subsection,
43
"biomass" means a power source that is comprised of combustible
44
residues, oils, or gases from forest products manufacturing,
45
agricultural and orchard crops, waste products from livestock
46
and poultry operations and food processing, urban wood waste,
47
biogenic municipal solid waste, municipal liquid waste treatment
48
operations, and landfill gas means electrical, mechanical, or
49
thermal energy produced from a method that uses one or more of
50
the following fuels or energy sources: hydrogen, biomass, solar
51
energy, geothermal energy, wind energy, ocean energy, waste
52
heat, or hydroelectric power.
