     403.7031  Limitations on definitions adopted by local

7

ordinance.--The department shall not issue any permit for a Class

8

I landfill that will be located on or adjacent to a Class III

9

landfill that was permitted on or before January 1, 2006 and that

10

is located in the Southern Water Use Caution Area designated by

11

rule by the Southwest Florida Water Management District. This

12

section applies to all applications for any Class I landfill

13

permit submitted after January 1, 2006 for which the department

14

has not issued a final permit. A county or a municipality shall

15

not adopt by ordinance any definition that is inconsistent with

16

the definitions in s. 403.703.
