| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. Section 938.135, Florida Statutes, is created |
| 11 | to read: |
| 12 | 938.135 Controlled substance possession or driving or |
| 13 | boating under the influence; police technology fee.--In addition |
| 14 | to any other court costs or fees, a court cost of $50 shall be |
| 15 | imposed for any conviction for possession of a controlled |
| 16 | substance in violation of s. 893.13(1)(a) and a court cost of |
| 17 | $50 shall be added to any fine imposed pursuant to s. 316.193 or |
| 18 | s. 327.35. The fee shall be deposited into the Police Technology |
| 19 | Trust Fund created in s. 943.082. |
| 20 | Section 2. This act shall take effect October 1, 2008. |
