A bill to be entitled
2An act relating to the Police Technology Trust Fund;
3creating s. 943.082, F.S.; creating the Police Technology
4Trust Fund within the Department of Law Enforcement;
5providing for administration of the trust fund and use of
6moneys therein; requiring balances to remain in the trust
7fund; providing for future review and termination or re-
8creation of the trust fund; providing a contingent
9effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 943.082, Florida Statutes, is created
14to read:
15     943.082  Police Technology Trust Fund.--
16     (1)  The Police Technology Trust Fund is created within the
17department. Funds credited to the trust fund shall consist of
18revenues collected from the fee imposed under s. 938.135. The
19trust fund shall be administered by the department and used to
20allocate funds to public county or municipal law enforcement
21agencies to purchase and maintain technology equipment to be
22used in their law enforcement activities. Equipment that may be
23purchased and maintained with grants under this section may
24include, but is not limited to, in-car cameras and personal
25digital recorders to record encounters with suspects. The fee
26collected for each offense shall be distributed only to the law
27enforcement agency responsible for the arrest for that offense.
28     (2)  Notwithstanding s. 216.301 and pursuant to s. 216.351,
29any balance in the trust fund at the end of any fiscal year
30shall remain in the trust fund and be available for carrying out
31the purposes of the trust fund.
32     (3)  Pursuant to the provisions of s. 19(f)(2), Art. III of
33the State Constitution, the trust fund shall, unless terminated
34sooner, be terminated on July 1, 2012. Prior to its scheduled
35termination, the trust fund shall be reviewed as provided in s.
36215.3206(1) and (2).
37     Section 2.  This act shall take effect October 1, 2008, if
38House Bill 155 or similar legislation is adopted in the same
39legislative session or an extension thereof and becomes law.
