An act relating to license plates; amending s. 320.089,

F.S.; expanding the types of veterans special license
4
plates from which revenues may be used to fund state
5
veterans' homes; providing for additional revenue from the
6
sale of such plates to be used to construct, maintain, and
7
operate the homes; amending s. 320.02, F.S.; providing for
8
a check-off provision on motor vehicle registration
9
application and renewal forms to authorize a voluntary
10
donation to the state veterans' homes; providing an
11
effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Paragraph (b) of subsection (1) of section
16
320.089, Florida Statutes, is amended to read:
17
320.089 Members of National Guard and active United States
18
Armed Forces reservists; former prisoners of war; survivors of
19
Pearl Harbor; Purple Heart medal recipients; Operation Iraqi
20
Freedom and Operation Enduring Freedom Veterans; special license
21
plates; fee.--

(b) Notwithstanding any other provision of law to the
24
contrary, beginning with fiscal year 2002-2003 and annually
25
thereafter, the first $100,000 in general revenue generated from
26
the sale of license plates issued under this section which are
27
stamped with the words "National Guard," "Pearl Harbor Survivor,"
28
"Combat-wounded veteran," or "U.S. Reserve" shall be deposited
29
into the Grants and Donations Trust Fund, as described in s.
30
296.38(2), to be used for the purposes established by law for
31
that trust fund. Any additional general revenue generated from
32
the sale of such plates, up to $100,000, shall be deposited into
33
the State Homes for Veterans Trust Fund and used solely to
34
construct, operate, and maintain domiciliary and nursing homes
35
for veterans, subject to the requirements of chapter 216.

Section 2. Paragraph (f) is added to subsection (16) of
37
section 320.02, Florida Statutes, to read:

320.02 Registration required; application for registration;

(f) The application form for motor vehicle registration and
42
renewal of registration must include language permitting a
43
voluntary contribution of $1 per applicant to the state homes for
44
veterans, to be distributed on a quarterly basis by the
45
department to the State Homes for Veterans Trust Fund, which is
46
administered by the Department of Veterans' Affairs.

For the purpose of applying the service charge provided in s.
49
215.20, contributions received under this subsection are not
50
income of a revenue nature.

Section 3. This act shall take effect July 1, 2008.
