The Committee on Health Regulation (Jones) recommended the

advisory against swimming in beach waters on the basis of finding

elevated levels of fecal coliform or enterococci bacteria in a
10
water sample, the Wastewater Compliance Evaluation Section of the
11
Department of Environmental Protection shall investigate
12
wastewater treatment facilities within 1 mile of the affected
13
beach to determine if a wastewater treatment facility experienced
14
an incident that may have contributed to the contamination.
15
(3) For purposes of this section, the term "beach waters"
16
means the waters along the coastal and intracoastal beaches and
17
shores of the state, and includes salt water and brackish water.
