The Committee on Health Regulation (Jones) recommended the

following substitute for amendment (632136):

to the state. When the Department of Health issues a health

9

advisory against swimming in beach waters on the basis of finding

10

elevated levels of fecal coliform or enterococci bacteria in a

11

water sample, the Wastewater Compliance Evaluation Section of the

12

Department of Environmental Protection shall investigate

13

wastewater treatment facilities within 1 mile of the affected

14

beach to determine if a wastewater treatment facility experienced

15

an incident that may have contributed to the contamination. The

16

Department of Health shall also notify the municipality or county

17

in which the affected beach is located of the health advisory.

18

Upon completion of its investigation or discovery of an incident

19

at a wastewater treatment facility, the Department of

20

Environmental Protection shall notify the municipality or county

21

in which the affected beach is located of the results of such

22

investigation.

     (3) For purposes of this section, the term "beach waters"

24

means the waters along the coastal and intracoastal beaches and

25

shores of the state, and includes salt water and brackish water.
