A bill to be entitled

An act relating to public school student health services;

3

amending s. 1006.062, F.S.; providing that a district

4

school board may authorize a school nurse to maintain

5

supplies of prefilled epinephrine auto-injectors at

6

schools in the school district; providing requirements for

7

prescriptions; authorizing use for emergency treatment;

8

amending s. 1002.20, F.S.; correcting a cross-reference;

9

providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Subsections (6) and (7) of section 1006.062,

14

Florida Statutes, are renumbered as subsections (7) and (8),

15

respectively, and a new subsection (6) is added to that section

16

to read:

17

     1006.062  Administration of medication and provision of

18

medical services by district school board personnel.--

     (6)(a) Each district school board may authorize a school

20

nurse who is licensed under chapter 464 and is employed by the

21

district school board to maintain at each school in the school

22

district an adequate supply of prefilled auto-injectors of

23

epinephrine with fifteen-hundredths milligram or three-tenths

24

milligram delivery. The school nurse shall recommend to the

25

district school board the number of prefilled epinephrine auto-

26

injectors to be maintained at each school.

     (b) To obtain prefilled epinephrine auto-injectors for a

28

school district, a written prescription from a physician or a

29

physician assistant licensed under chapter 458 or chapter 459 or

30

a nurse licensed under chapter 464 is required. The school

31

nurse's name must appear on the prescription, the school district

32

must be designated as the patient, and the prescription must be

33

filled at a pharmacy licensed under chapter 465.

     (c) Based on a school nurse's training in recognizing an

35

acute episode of an anaphylactic reaction, the school nurse shall

36

have the discretion to use an epinephrine auto-injector on any

37

student that he or she believes is having a life-threatening

38

anaphylactic reaction.

     Section 2.  Paragraph (e) of subsection (3) of section

40

1002.20, Florida Statutes, is amended to read:

41

     1002.20  K-12 student and parent rights.--Parents of public

42

school students must receive accurate and timely information

43

regarding their child's academic progress and must be informed of

44

ways they can help their child to succeed in school. K-12

45

students and their parents are afforded numerous statutory rights

46

including, but not limited to, the following:

47

     (3)  HEALTH ISSUES.--

48

     (e)  Contraceptive services to public school students.--In

49

accordance with the provisions of s. 1006.062(8)(7), students may

50

not be referred to or offered contraceptive services at school

51

facilities without the parent's consent.

     Section 3.  This act shall take effect July 1, 2008.
