10 | rules; repealing s. 320.96, F.S., relating to |
11 | implementation of an electronic, print-on-demand, |
12 | temporary license plate system; providing an effective |
13 | date. |

15 | Be It Enacted by the Legislature of the State of Florida: |
16 |

17 | Section 1. Subsections (4) and (8) of section 320.131, |
18 | Florida Statutes, are amended, and subsection (9) is added to |
19 | that section, to read: |
20 | 320.131 Temporary tags.-- |
21 | (4)(a) Temporary tags shall be conspicuously displayed in |
22 | the rear license plate bracket or, attached to the inside of the |
23 | rear window in an upright position so as to be clearly visible |
24 | from the rear of the vehicle. on vehicles requiring front |
25 | display of license plates, temporary tags shall be displayed on |
26 | the front of the vehicle in the location where the metal license |
27 | plate would normally be displayed. |
28 | (b) The department shall designate specifications for the |
29 | media upon which the temporary tag is printed. Such media shall |
30 | be either nonpermeable or subject to weatherproofing so that it |
31 | maintains its structural integrity, including graphic and data |
32 | adhesion, in all weather conditions after being placed on a |
33 | vehicle. |
34 | (8) The department shall may administer an electronic |
35 | system for licensed motor vehicle dealers to use for in issuing |
36 | temporary tags license plates. Upon issuing a temporary license |
37 | plate, the dealer shall access the electronic system and enter |
38 | the appropriate vehicle and owner information within the |
39 | timeframe specified by department rule. If a dealer fails to |
40 | comply with the department's requirements for issuing temporary |
41 | tags license plates using the electronic system, the department |
42 | may deny, suspend, or revoke a license under s. 320.27(9)(b)16. |
43 | upon proof that the licensee has failed to comply with the |
44 | department's requirements. The department may adopt rules to |
45 | administer this section. |
46 | (9)(a) The department shall implement a secure print-on- |
47 | demand electronic temporary tag registration, record retention, |
48 | and issue system required for use by every department-authorized |
49 | issuer of temporary tags by the end of the 2007-2008 fiscal |
50 | year. This system shall enable the department to issue, on |
51 | demand, a temporary tag number in response to a request from the |
52 | issuer by way of a secure electronic exchange of data and then |
53 | enable the issuer to print the temporary tag with all required |
54 | information. A motor vehicle dealer licensed under ch. 320 shall |
55 | be authorized to charge a fee to comply with this subsection. |
56 | (b) To ensure the continuation of operations for issuers if |
57 | a system outage occurs, the department shall allow limited use |
58 | of a backup manual issuance method during an outage which |
59 | requires the record keeping of information as determined by the |
60 | department and which requires the timely electronic reporting of |
61 | this information to the department. |
62 | (c) The department may adopt rules as necessary to |
63 | implement this subsection. Such rules may include exemptions |
64 | from the requirements of this subsection as feasibly required to |
65 | implement the program, as well as for issuers who do not require |
66 | a dealer license under this chapter because of the type or size |
67 | of vehicle being sold. |
68 | Section 2. Section 320.96, Florida Statutes, is repealed. |
69 | Section 3. This act shall take effect upon becoming a law. |
