insert:

     Section 13.  Paragraph (i) of subsection (4) of section

7

400.9905, Florida Statutes, is amended to read:

     400.9905  Definitions.--

9

     (4)  "Clinic" means an entity at which health care services

10

are provided to individuals and which tenders charges for

11

reimbursement for such services, including a mobile clinic and a

12

portable equipment provider. For purposes of this part, the term

13

does not include and the licensure requirements of this part do

14

not apply to:

15

     (i)  Entities that provide only oncology or radiation

16

therapy services by physicians licensed under chapter 458 or

17

chapter 459, or entities that provide oncology or radiation

18

therapy services by physicians licensed under chapter 458 or

19

chapter 459 which are owned by a corporation whose shares are

20

publicly traded on a recognized stock exchange, or entities

21

providing oncology or radiation therapy services, whether at a

22

single location or multiple locations, by or under the

23

supervision of physicians licensed under chapter 458 or chapter

24

459, where the entity derives more than 50 percent of its total

25

revenues from those services.

insert:

amending s. 400.9905, F.S.; redefining the term

"clinic" for purposes of the Health Care Clinic Act to

deriving a certain percentage of gross annual revenue

35

from oncology services or radiation therapy;
