Section 1. Subsection (4) of section 1009.24, Florida
8
Statutes, is amended to read:

1009.24 State university student fees.--
10
(4)(a)1. Effective January 1, 2008, undergraduate tuition
11
is $77.39 per credit hour.

2. Beginning with the 2008-2009 fiscal year and each year
13
thereafter, the undergraduate tuition per credit hour shall
14
increase at the beginning of each fall semester at a rate equal
15
to inflation, unless otherwise provided Except as otherwise
16
provided by law, undergraduate tuition shall be established
17
annually in the General Appropriations Act. The Office of
18
Economic and Demographic Research shall report the rate of
19
inflation to the Governor, the President of the Senate, the
20
Speaker of the House of Representatives, and the Board of
21
Governors each year before March 1. For purposes of this
22
subparagraph, the rate of inflation is the rate of the 12-month
23
percentage change in the Consumer Price Index for All Urban
24
Consumers, U.S. City Average, All Items, or successor reports as
25
reported by the United States Department of Labor, Bureau of
26
Labor Statistics, or its successor for December of the previous
27
year. If the percentage change is negative, the undergraduate
28
tuition shall remain at the same level as the prior fiscal year.

3. The Board of Governors, or the board's designee, may
30
establish the out-of-state fee for undergraduate courses. The sum
31
of the undergraduate tuition and the out-of-state fee assessed to
32
nonresident students for undergraduate courses must be sufficient
33
to offset the full instructional cost of serving such students.

However, adjustments to the out-of-state fee pursuant to this
35
subparagraph may not exceed 10 percent in any year.

(b) The Board of Governors, or the board's designee, may
37
establish tuition for graduate tuition and professional programs,
38
and the out-of-state fee fees for graduate-level courses all
39
programs. The sum of graduate tuition and the out-of-state fee
40
fees assessed to nonresident students for graduate-level courses
41
must be sufficient to offset the full instructional cost of
42
serving such students. However, adjustments to the out-of-state
43
fee fees or graduate tuition for graduate and professional
44
programs pursuant to this paragraph section may not exceed 10
45
percent in any year.

(c) Each university board of trustees may establish tuition
47
and the out-of-state fee for each professional program offered by
48
the university. The sum of tuition and the out-of-state fee
49
assessed to nonresident students in professional programs must be
50
sufficient to offset the full instructional cost of serving such
51
students. Adjustments to tuition or the out-of-state fee for any
52
student who was enrolled in a professional program before the
53
2008 fall term and maintained continuous enrollment in good
54
academic standing in such program as determined by the university
55
may not exceed 10 percent in any year.

(d) The sum of the activity and service, health, and
57
athletic fees a student is required to pay to register for a
58
course may shall not exceed 40 percent of the tuition established
59
in law or in the General Appropriations Act. A No university may
60
not shall be required to lower any fee in effect on the effective
61
date of this act in order to comply with this paragraph
62
subsection. Within the 40 percent cap, universities may not
63
increase the aggregate sum of activity and service, health, and
64
athletic fees more than 5 percent per year unless specifically
65
authorized in law or in the General Appropriations Act. A
66
university may increase its athletic fee to defray the costs
67
associated with changing National Collegiate Athletic Association
68
divisions. Any such increase in the athletic fee may exceed both
69
the 40 percent cap and the 5 percent cap imposed by this
70
paragraph subsection. Any such increase must be approved by the
71
athletic fee committee in the process outlined in subsection (11)
72
and cannot exceed $2 per credit hour. Notwithstanding the
73
provisions of ss. 1009.534, 1009.535, and 1009.536, that portion
74
of any increase in an athletic fee pursuant to this subsection
75
that causes the sum of the activity and service, health, and
76
athletic fees to exceed the 40 percent cap or the annual increase
77
in such fees to exceed the 5 percent cap shall not be included in
78
calculating the amount a student receives for a Florida Academic
79
Scholars award, a Florida Medallion Scholars award, or a Florida
80
Gold Seal Vocational Scholars award.

(e) This subsection does not prohibit a university from
82
increasing or assessing optional fees related to specific
83
activities if payment of such fees is not required as a part of
84
registration for courses.
