An act relating to postsecondary student fees; amending s.

1009.22, F.S.; revising provisions relating to workforce

education postsecondary student fees; prohibiting the fee
5
from exceeding a certain percentage of the tuition per
6
credit hour and the out-of-state fee; requiring that such
7
fees be used to enhance instructional technology
8
resources; prohibiting the fee from being included in any
9
award under the Florida Bright Futures Scholarship
10
Program; amending s. 1009.23, F.S.; conforming provisions
11
relating to community college student fees to changes made
12
by the act; amending s. 1009.24, F.S.; revising provisions
13
relating to state university student fees; requiring a
14
referendum of the student body in which a majority of the
15
students vote to establish the technology fee; requiring
16
each university board of trustees to report to the
17
Legislature and the Board of Governors by a certain date
18
each year regarding such fee; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:
21

Section 1. Subsection (7) of section 1009.22, Florida
23
Statutes, is amended to read:
24
1009.22 Workforce education postsecondary student fees.--
25
(7) Each district school board and community college board
26
of trustees is authorized to establish a separate fee for
27
technology, not to exceed 5 percent of the tuition per credit
28
hour and the out-of-state fee $1.80 per credit hour or credit-
29
hour equivalent for resident students and not more than $5.40 per
30
credit hour or credit-hour equivalent for nonresident students,
31
or the equivalent, to be used to enhance instructional technology
32
resources for students and faculty and shall not be included in
33
any award under the Florida Bright Futures Scholarship Program
34
expended in accordance with technology improvement plans. The
35
technology fee may apply only to associate degree programs and
36
courses. Fifty percent of technology fee revenues may be pledged
37
by a community college board of trustees as a dedicated revenue
38
source for the repayment of debt, including lease-purchase
39
agreements, not to exceed the useful life of the asset being
40
financed. Revenues generated from the technology fee may not be
41
bonded.

Section 2. Subsections (3) and (10) of section 1009.23,
43
Florida Statutes, are amended to read:
44
1009.23 Community college student fees.--
45
(3)(a) Effective January 1, 2008, for advanced and
46
professional, postsecondary vocational, college preparatory, and
47
educator preparation institute programs, the following tuition
48
and fee rates shall apply:
49
1. The sum of the standard tuition and the technology fee
50
shall be $51.35 per credit hour for students who are residents
51
for tuition purposes.
52
2. The sum of the standard tuition, the technology fee, and
53
the out-of-state fee shall be $154.14 per credit hour for
54
students who are nonresidents for tuition purposes.

(b) Effective January 1, 2008, for baccalaureate degree
56
programs, the following tuition and fee rates shall apply:
57
1. The sum of the tuition and the technology fee shall be
58
$65.47 per credit hour for students who are residents for tuition
59
purposes.

2. The sum of the tuition, the technology fee, and the out-
61
of-state fee per credit hour for students who are nonresidents
62
for tuition purposes shall be no more than 85 percent of the sum
63
of the tuition and the out-of-state fee at the state university
64
nearest the community college.

(c) Beginning with the 2008-2009 fiscal year and each year
66
thereafter, the tuition and fees specified in paragraphs (a) and
67
(b) shall increase at the beginning of each fall semester at a
68
rate equal to inflation, unless otherwise provided in the General
69
Appropriations Act. The Office of Economic and Demographic
70
Research shall report the rate of inflation to the President of
71
the Senate, the Speaker of the House of Representatives, the
72
Governor, and the State Board of Education each year prior to
73
March 1. For purposes of this paragraph, the rate of inflation
74
shall be defined as the rate of the 12-month percentage change in
75
the Consumer Price Index for All Urban Consumers, U.S. City
76
Average, All Items, or successor reports as reported by the
77
United States Department of Labor, Bureau of Labor Statistics, or
78
its successor for December of the previous year. In the event the
79
percentage change is negative, the sum of the tuition and the
80
technology fee per credit hour and the out-of-state fee per
81
credit hour shall remain at the same levels as the prior fiscal
82
year.

(10) Each community college board of trustees is authorized
84
to establish a separate fee for technology, which may not exceed
85
5 percent of the tuition per credit hour and the out-of-state fee
86
$1.80 per credit hour or credit-hour equivalent for resident
87
students and not more than $5.40 per credit hour or credit-hour
88
equivalent for nonresident students, to be used to enhance
89
instructional technology resources for students and faculty
90
expended according to technology improvement plans. The
91
technology fee may apply to both college credit and college-
92
preparatory instruction and shall not be included in any award
93
under the Florida Bright Futures Scholarship Program. Fifty
94
percent of technology fee revenues may be pledged by a community
95
college board of trustees as a dedicated revenue source for the
96
repayment of debt, including lease-purchase agreements, not to
97
exceed the useful life of the asset being financed. Revenues
98
generated from the technology fee may not be bonded.

Section 3. Paragraph (s) of subsection (13) of section
100
1009.24, Florida Statutes, as created by section 5 of chapter
101
2007-329, Laws of Florida, is amended to read:
102
1009.24 State university student fees.--
103
(13) Each university board of trustees is authorized to
104
establish the following fees:
105
(s) A technology fee of up to 5 percent of the tuition per
106
credit hour, beginning with the fall term of the 2009-2010
107
academic year. The establishment of this fee is contingent upon a
108
referendum of the student body in which a majority of the
109
students participating in such referendum vote to support the
110
establishment of the technology fee. The revenue from this fee
111
shall be used to enhance instructional technology resources for
112
students and faculty. By September 1 of each year, each board of
113
trustees shall report to the President of the Senate, the Speaker
114
of the House of Representatives, and the Board of Governors the
115
total amount of revenue generated by the technology fee for the
116
prior academic year and how the revenue was expended to support
117
technology as required in this paragraph. The technology fee
118
shall not be included in any award under the Florida Bright
119
Futures Scholarship Program.

Section 4. This act shall take effect July 1, 2008.
