An act relating to prisoners; authorizing any nonprofit or

public health care organization to distribute sexual

4

barrier protection devices to prisoners in prisons;

5

requiring the Department of Corrections to develop a plan

6

to properly dispose of used sexual barrier protection

7

devices; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. (1) The Department of Corrections shall allow

12

any nonprofit or public health care organization to distribute

13

sexual barrier protection devices, such as condoms, to prisoners.

14

The health care organization is subject to all laws and rules

15

governing visitors to a correctional facility.

16

     (2) The distribution of sexual barrier protection devices

17

is not a crime and is not deemed to encourage sexual acts between

18

prisoners.

     (3) The Department of Corrections may not use possession of

20

a device distributed under subsection (1) as evidence of illegal

21

activity for purposes of administrative sanctions.

     (4) The Department of Corrections shall develop a plan for

23

disposing of used sexual barrier protection devices which

24

protects the anonymity of prisoners and the health of

25

correctional officers.

     Section 2.  This act shall take effect July 1, 2008.
