An act relating to state uniform traffic control; amending
3
s. 316.515, F.S.; revising provisions relating to the
4
movement of certain trucks, tractors, and other vehicles
5
used in the production or transportation of agricultural
6
products on certain roads in this state; increasing the
7
width of vehicles permitted for such purposes; providing
8
limitations on such use; providing for trip permits issued
9
by the Department of Transportation; providing for permit
10
fees; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Subsection (5) of section 316.515, Florida
15
Statutes, is amended to read:
16
(5) AGRICULTURAL EQUIPMENT AND IMPLEMENTS OF HUSBANDRY;
17
AGRICULTURAL TRAILERS; FORESTRY EQUIPMENT; SAFETY REQUIREMENTS.--

(a) Notwithstanding any other provisions of law, straight
19
trucks, agricultural tractors, and cotton module movers, not
20
exceeding 50 feet in length, or any combination of up to and
21
including three implements of husbandry, including the towing
22
power unit, and any single agricultural trailer with a load
23
thereon or any agricultural implements attached to a towing power
24
unit not exceeding 130 inches in width, or a self-propelled
25
agricultural implement or an agricultural tractor not exceeding
26
130 inches in width, is authorized for the purpose of
27
transporting peanuts, grains, soybeans, cotton, hay, straw, or
28
other perishable farm products from their point of production to
29
the first point of change of custody or of long-term storage, and
30
for the purpose of returning to such point of production, or for
31
the purpose of moving such tractors, movers, and implements from
32
one point of agricultural production to another, by a person
33
engaged in the production of any such product or custom hauler,
34
if such vehicle or combination of vehicles otherwise complies
35
with this section. The Department of Transportation may issue
36
overwidth permits for implements of husbandry greater than 130
37
inches, but not more than 170 inches, in width. The Department of
38
Transportation may issue overlength permits for cotton module
39
movers greater than 50 feet but not more than 55 feet in overall
40
length. Such vehicles shall be operated in accordance with all
41
safety requirements prescribed by law and rules of the Department
42
of Transportation.

(b) Notwithstanding any other provisions of law,
44
agricultural equipment and implements of husbandry not exceeding
45
192 inches in width and used for agricultural purposes are
46
authorized for the purpose of moving from one point of
47
agricultural production to another, if such movement is performed
48
during daylight hours within a radius of 50 miles from the point
49
of origin thereof and no part of such movement is upon any
50
highway designated as a part of the National System of Interstate
51
and Defense Highways or any fully controlled access highway
52
facility. The Department of Transportation may issue blanket
53
multi-trip overwidth permits for agricultural equipment and
54
implements of husbandry greater than 192 inches, but no more than
55
264 inches in width. The annual blanket multi-trip permit fee
56
shall be $25. The Department of Transportation may issue single-
57
trip overwidth permits for agricultural equipment and implements
58
of husbandry greater than 264 inches in width. The single-trip
59
permit fee shall be $50 and the equipment must have flags,
60
lights, signs, and an escort. Such vehicles shall be operated in
61
accordance with all safety requirements prescribed by law and
62
rules of the Department of Transportation.

(c)(b) Notwithstanding any other provision of law,
64
equipment not exceeding 136 inches in width and not capable of
65
speeds exceeding 20 miles per hour which is used exclusively for
66
harvesting forestry products is authorized for the purpose of
67
transporting equipment from one point of harvest to another point
68
of harvest, not to exceed 10 miles, by a person engaged in the
69
harvesting of forestry products. Such vehicles must be operated
70
during daylight hours only, in accordance with all safety
71
requirements prescribed by s. 316.2295(5) and (6).

Section 2. This act shall take effect July 1, 2008.
