and insert:

     Section 2.  Section 500.70, Florida Statutes, is created to

7

read:

8

     500.70 Food safety practices relating to tomatoes.--A

9

tomato farmer, packer, repacker, or handler that implements

10

applicable good agricultural practices and best-management

11

practices in accordance with rules adopted by the department is

12

considered to have acted in good faith, with reasonable care, and

13

in compliance with state food safety microbial standards or

14

guidelines unless a violation of, or noncompliance with, such

15

measures can be shown through inspections.

     Section 3.  Subsection (10) of section 570.07, Florida

17

Statutes, is amended to read:

18

     570.07  Department of Agriculture and Consumer Services;

19

functions, powers, and duties.--The department shall have and

20

exercise the following functions, powers, and duties:

21

     (10)  To act as adviser to producers and distributors, when

22

requested, and to assist them in the economical and efficient

23

distribution of their agricultural products and to encourage

24

cooperative effort among producers to gain economical and

25

efficient production of agricultural products. The department may

26

adopt by rule, pursuant to s. 120.536(1) and s. 120.54,

27

comprehensive best-management practices for agricultural

28

production and food safety.

     Section 4.  This act shall take effect July 1, 2008.

establishing the Pest Control Compact; providing for

37

enactment of the compact; requiring the Commissioner of

38

Agriculture to administer the compact; requiring that an

39

application for assistance under the compact be made by

40

the commissioner; providing for crediting of funds to

41

appropriate accounts of a state treasury under certain

42

circumstances; providing findings with respect to the need

43

for all states to cooperate in pest-eradication and

44

control programs; providing definitions; providing for the

45

establishment of the Pest Control Insurance Fund for the

46

purpose of financing pest-control operations under the

47

compact; specifying sources of funds deposited into the

48

Pest Control Insurance Fund and any conditions that may be

49

placed on such funds; providing for the Pest Control

50

Insurance Fund to be administered by a Governing Board and

51

Executive Committee; providing for the internal operations

52

and management of the Governing Board; requiring an annual

53

report to the Governor and Legislature of each state that

54

is a party to the compact; providing for the

55

administration of the compact and the Pest Control

56

Insurance Fund; providing procedures for applying for an

57

expenditure from the fund; providing for a determination

58

with respect to expenditures from the fund and for the

59

review thereof; authorizing the Governing Board to

60

establish advisory and technical committees; providing for

61

an application for assistance from the fund on behalf of a

62

nonparty state; providing requirements for the fund with

63

respect to preparing budgets and maintaining financial

64

assets; prohibiting a pledge of the assets of a state that

65

is a party to the compact; providing for the compact to

66

enter into force upon its enactment by five or more

67

states; providing a procedure for a state to withdraw from

68

the compact; providing for construction and severability;

69

creating s. 500.70, F.S.; providing that a tomato farmer,

70

packer, repacker, or handler that implements certain

71

practices is considered to be acting in good faith;

72

amending s. 570.07, F.S.; authorizing the Department of

73

Agriculture and Consumer Services to adopt rules relating

74

to best-management practices for agricultural production

75

and food safety;
