An act relating to community residential homes; amending

s. 419.001, F.S.; requiring additional security be

4

provided at a community residential home or dwelling unit

5

if clients of specified state agencies or a sponsoring

6

agency have been referred to the community residential

7

home or dwelling unit by a criminal justice agency or a

8

judge of a criminal court; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Subsection (9) of section 419.001, Florida

13

Statutes, is amended to read:

14

     419.001  Site selection of community residential homes.--

15

     (9)(a) Nothing in This section does not shall permit

16

persons to occupy a community residential home who would

17

constitute a direct threat to the health and safety of other

18

persons or whose residency would result in substantial physical

19

damage to the property of others.

     (b) A community residential home or dwelling unit that

21

receives residents who are clients of the Department of Elderly

22

Affairs, the Agency for Persons with Disabilities, the Department

23

of Juvenile Justice, the Department of Children and Family

24

Services, the Agency for Health Care Administration, or a

25

sponsoring agency who have been referred to the community

26

residential home or dwelling unit by a criminal justice agency or

27

a judge of a criminal court must provide 24-hour security at the

28

community residential home or dwelling unit in order to protect

29

the health, safety, and welfare of the other residents of the

30

community residential home or dwelling unit and the residents of

31

the surrounding community.

     Section 2.  This act shall take effect upon becoming a law.
