| 5 | Section 48. Subsection (15) is added to section 311.125, |
| 6 | Florida Statutes, to read: |
| 7 | 311.125 Uniform Port Access Credential System.-- |
| 8 | (15) The Department of Highway Safety and Motor Vehicles |
| 9 | may accept a Transportation Security Administration's |
| 10 | Transportation Worker Identification Credential card in lieu of |
| 11 | the Uniform Port Access Credential Card required under this |
| 12 | section. For purposes of s. 311.12, state seaports shall accept |
| 13 | the criminal history and security threat assessment conducted on |
| 14 | individuals holding a valid Transportation Worker Identification |
| 15 | Credential card as sufficient to authorize unescorted access to |
| 16 | a seaport or restricted access area; provided that state |
| 17 | seaports shall request in writing from the individual whether |
| 18 | they have received a federal criminal history waiver and the |
| 19 | reason for such waiver. Such information shall not be subject to |
| 20 | disclosure pursuant to federal law; however, the information |
| 21 | shall be submitted to the Florida Department of Law Enforcement. |
| 22 | The department may set and collect a fee for entering a |
| 23 | Transportation Worker Identification Credential cardholder into |
| 24 | the Uniform Port Access Credential System. The fee may not |
| 25 | exceed the department's actual cost. |
