The Committee on Transportation (Baker) recommended the

following amendment:

     Section 40. (1) The Automobile Lenders Industry Task

8

Force is created within the Department of Highway Safety and

9

Motor Vehicles. The task force shall make recommendations on

10

proposed legislation and proposed department rules, shall

11

present issues concerning the motor vehicle lending industry to

12

the department for its consideration, shall consider any matters

13

relating to the motor vehicle lending industry which are

14

presented to it by the department, and shall submit a final

15

report, including legislative proposals to the Governor, the

16

President of the Senate, the Speaker of the House of

17

Representatives and appropriate committees within the

18

Legislature by June 30, 2009, when the task force shall cease to

19

exist.

     (2) The task force shall be composed of 12 members

21

appointed by each of the following organizations: one

22

representative of the Department of Highway Safety and Motor

23

Vehicles; one representative of the independent motor vehicle

24

industry, appointed by the Florida Independent Automobile

25

Dealers Association; one representative of the franchise motor

26

vehicle industry, appointed by the Florida Automobile Dealers

27

Association; one representative of credit unions, appointed by

28

the Florida Credit Union League; one representative of the

29

banking industry, appointed by the Florida Bankers Association;

30

one representative of the insurance industry, appointed by the

31

Florida Insurance Council; one state attorney, appointed by the

32

Florida State Attorneys Association; one representative of the

33

Office of Financial Regulation of the Department of Financial

34

Services; one representative of a law enforcement agency,

35

appointed by the Florida Auto Theft Intelligence Unit; one

36

representative of the auto repair industry, appointed by the

37

Florida Automotive Services Association; one representative of

38

the towing industry, appointed by the Professional Wrecker

39

Operators of Florida; and one representative of independent

40

motor vehicle finance companies, appointed by the Florida

41

Financial Services Association.

     (3)(a) The task force shall elect a chair and vice chair

43

at its initial meeting, which shall be held by July 15, 2008.

44

     (b) The task force shall meet at least four times in

45

different areas of the state, including one meeting in

46

Tallahassee. Meetings may be called by the chair or by a simple

47

majority of the members. The task force shall conduct all

48

meetings pursuant to general law and shall keep minutes of its

49

meetings. Meetings may be held in locations around the state in

50

department facilities or in other appropriate locations. The

51

department shall provide administrative support to the task

52

force.

     (3) Members from the private sector are not entitled to

54

per diem or reimbursement for travel expenses. However, members

55

from the public sector are entitled to reimbursement, if any,

56

from their respective agency. The task force may request

57

assistance from the Department of Highway Safety and Motor

58

Vehicles as necessary.
