An act relating to impact fees; amending s. 163.31801,

F.S.; revising requirements governing notice of changes in

4

impact fees adopted by ordinance of a county or

5

municipality or by resolution of a special district;

6

requiring the provision of notice before the imposition of

7

an increased impact fee; providing that the provision of

8

notice is not required before decreasing or eliminating an

9

impact fee; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Paragraph (d) of subsection (3) of section

14

163.31801, Florida Statutes, is amended to read:

15

     163.31801  Impact fees; short title; intent; definitions;

16

ordinances levying impact fees.--

17

     (3)  An impact fee adopted by ordinance of a county or

18

municipality or by resolution of a special district must, at

19

minimum:

20

     (d)  Require that notice be provided no less than 90 days

21

before the effective date of an ordinance or resolution imposing

22

a new or increased amended impact fee. Notice is not required if

23

an impact fee is decreased or eliminated.

24

     Section 2.  This act shall take effect July 1, 2008.
