An act relating to water and wastewater utilities;

amending s. 367.0814, F.S.; revising provisions

authorizing utilities having a gross annual revenue of

5

less than a specified amount to request assistance from

6

the Public Service Commission in changing the rates and

7

charges of the utility; providing for an annual adjustment

8

in the threshold; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Subsection (1) of section 367.0814, Florida

13

Statutes, is amended to read:

14

     367.0814  Staff assistance in changing rates and charges;

15

interim rates.--

16

     (1)  The commission may establish rules by which a water or

17

wastewater utility whose gross annual revenues are $250,000

18

$150,000 or less may request and obtain staff assistance for the

19

purpose of changing its rates and charges. A utility may request

20

staff assistance by filing an application with the commission.

The gross annual revenue level may be adjusted each year based on

22

the price index established by the commission pursuant to s.

23

367.081(4)(a).

     Section 2.  This act shall take effect July 1, 2008.
