A bill to be entitled

An act relating to motor vehicles; amending s. 316.2015,

3

F.S.; prohibiting the operator of a pickup or flatbed

4

truck from allowing a minor to ride in the open body of

5

the pickup or flatbed truck while on a public road unless

6

the minor is restrained in safety restraints or secure

7

seating; providing certain exceptions; providing that a

8

county is exempt from the requirement upon a majority vote

9

of the governing body of the county; providing an

10

effective date.

Be It Enacted by the Legislature of the State of Florida:

13

     Section 1.  Paragraph (b) of subsection (2) of section

15

316.2015, Florida Statutes, is amended to read:

16

     316.2015  Unlawful for person to ride on exterior of

17

vehicle.--

     (2)

     (b)  It is unlawful for any operator of a pickup truck or

20

flatbed truck to permit a minor child who has not attained 18

21

years of age to ride upon a public road limited access facilities

22

of the state within the open body of a pickup truck or flatbed

23

truck unless the minor is restrained within the open body in the

24

back of a truck that has been modified to include secure seating

25

and safety restraints or secure seating with safety restraints in

26

order to prevent the passenger from being thrown, falling, or

27

jumping from the truck. This paragraph does not apply in a

28

medical emergency or natural disaster if the child is accompanied

29

within the truck by an adult. A county is exempt from this

30

paragraph if the governing body of the county, by majority vote,

31

following a noticed public hearing, votes to exempt the county

32

from this paragraph.

     Section 2.  This act shall take effect July 1, 2008.
