Senator Villalobos moved the following amendment:

     Delete lines 1534 through 1542

and insert:

or hurricane protection that complies with or exceeds the

7

applicable building code, or both, except that a vote of the

8

owners is not required if the maintenance, repair, and

9

replacement of hurricane shutters or other forms of hurricane

10

protection are the responsibility of the association pursuant to

11

the declaration of condominium and may maintain, repair, or

12

replace such approved hurricane shutters, whether on or within

13

common elements, limited common elements, units, or association

14

property. However, where hurricane protection or laminated glass

15

or window film architecturally designed to function as hurricane

16

protection which complies with or exceeds the current applicable

17

building code has been previously installed, the board may not

18

install hurricane shutters or other hurricane protection. The
