An act relating to trust funds; re-creating the Shared

County/State Juvenile Detention Trust Fund within the
4
Department of Juvenile Justice without modification;
5
repealing s. 985.6015(3), F.S.; abrogating provisions
6
relating to the termination of the trust fund, to conform;
7
amending s. 985.686, F.S.; requiring counties to deposit
8
funds for the costs for juvenile detention into the Shared
9
County/State Juvenile Detention Trust Fund rather than the
10
Juvenile Justice Grants and Donations Trust Fund;
11
providing an effective date.

WHEREAS, the Legislature wishes to extend the life of the
14
Shared County/State Juvenile Detention Trust Fund within the
15
Department of Juvenile Justice, which is otherwise scheduled to
16
be terminated pursuant to constitutional mandate, and
17
WHEREAS, the Legislature has reviewed the trust fund before
18
its scheduled termination date and has found it continues to meet
19
an important public purpose, and
20
WHEREAS, the Legislature has found that existing public
21
policy concerning the trust fund sets adequate parameters for its
22
use, NOW, THEREFORE,

Be It Enacted by the Legislature of the State of Florida:

Section 1. The Shared County/State Juvenile Detention Trust
27
Fund within the Department of Juvenile Justice, FLAIR number 80-
28
2-685, which is to be terminated pursuant to Section 19(f),
29
Article III of the State Constitution on July 1, 2009, is re-
30
created.

Section 2. Subsection (3) of section 985.6015, Florida
32
Statutes, is repealed.

Section 3. Subsection (6) of section 985.686, Florida
34
Statutes, is amended to read:

985.686 Shared county and state responsibility for juvenile
36
detention.--

(6) Each county shall pay to the department for deposit
38
into the Shared County/State Juvenile Detention Juvenile Justice
39
Grants and Donations Trust Fund its share of the county's total
40
costs for juvenile detention, based upon calculations published
41
by the department with input from the counties.

Section 4. This act shall take effect July 1, 2008.
