A bill to be entitled

An act relating to trust funds; re-creating the Welfare

3

Transition Trust Fund within the Department of Children

4

and Family Services without modification; carrying forward

5

current balances and continuing current sources and uses

6

thereof; amending s. 20.506, F.S.; removing the scheduled

7

termination of the trust fund; providing an effective

8

date.

     WHEREAS, the Legislature wishes to extend the life of the

11

Welfare Transition Trust Fund within the Department of Children

12

and Family Services, which is otherwise scheduled to be

13

terminated pursuant to constitutional mandate, and

14

     WHEREAS, the Legislature has reviewed the trust fund before

15

its scheduled termination date and has found that it continues to

16

meet an important public purpose, and

17

     WHEREAS, the Legislature has found that existing public

18

policy concerning the trust fund sets adequate parameters for its

19

use, NOW, THEREFORE,

Be It Enacted by the Legislature of the State of Florida:

     Section 1. (1) The Welfare Transition Trust Fund within

24

the Department of Children and Family Services, FLAIR number 60-

25

2-401, which is to be terminated pursuant to Section 19(f),

26

Article III of the State Constitution on July 1, 2008, is re-

27

created.

     (2) All current balances of the trust fund are carried

29

forward, and all current sources and uses of the trust fund are

30

continued.

     Section 2.  Section 20.506, Florida Statutes, is amended to

32

read:

     20.506  Welfare Transition Trust Fund.--

34

     (1) The Welfare Transition Trust Fund is created within the

35

Department of Children and Family Services for the purposes of

36

receiving federal funds under the Temporary Assistance for Needy

37

Families Program. Trust fund moneys shall be used exclusively for

38

the purpose of providing services to individuals eligible for

39

Temporary Assistance for Needy Families pursuant to the

40

requirements and limitations of part A of Title IV of the Social

41

Security Act, as amended, or any other applicable federal

42

requirement or limitation. Funds credited to the trust fund

43

consist of those funds collected from the Temporary Assistance

44

for Needy Families Block Grant.

     (2) In accordance with s. 19(f)(2), Art. III of the State

46

Constitution, the Welfare Transition Trust Fund shall be

47

terminated on July 1, 2008, unless terminated sooner. Before its

48

scheduled termination, the trust fund shall be reviewed as

49

provided in s. 215.3206(1) and (2).

     Section 3.  This act shall take effect July 1, 2008.
