An act relating to trust funds; re-creating the Welfare

3

Transition Trust Fund within the Department of Health

4

without modification; carrying forward current balances

5

and continuing current sources and uses thereof; amending

6

s. 20.435, F.S.; removing the scheduled termination of the

7

trust fund; providing an effective date.

     WHEREAS, the Legislature wishes to extend the life of the

10

Welfare Transition Trust Fund within the Department of Health,

11

which is otherwise scheduled to be terminated pursuant to

12

constitutional mandate, and

13

     WHEREAS, the Legislature has reviewed the trust fund before

14

its scheduled termination date and has found that it continues to

15

meet an important public purpose, and

16

     WHEREAS, the Legislature has found that existing public

17

policy concerning the trust fund sets adequate parameters for its

18

use, NOW, THEREFORE,

Be It Enacted by the Legislature of the State of Florida:

     Section 1. (1) The Welfare Transition Trust Fund within

23

the Department of Health, FLAIR number 64-2-401, which is to be

24

terminated pursuant to Section 19(f), Article III of the State

25

Constitution on July 1, 2008, is re-created.

26

     (2) All current balances of the trust fund are carried

27

forward, and all current sources and uses of the trust fund are

28

continued.

     Section 2.  Paragraph (i) of subsection (1) of section

30

20.435, Florida Statutes, is amended to read:

     20.435  Department of Health; trust funds.--

32

     (1)  The following trust funds are hereby created, to be

33

administered by the Department of Health:

34

     (i)  Welfare Transition Trust Fund.

     1. The Welfare Transition Trust Fund is created within the

36

Department of Health for the purposes of receiving federal funds

37

under the Temporary Assistance for Needy Families Program. Trust

38

fund moneys shall be used exclusively for the purpose of

39

providing services to individuals eligible for Temporary

40

Assistance for Needy Families pursuant to the requirements and

41

limitations of part A of Title IV of the Social Security Act, as

42

amended, or any other applicable federal requirement or

43

limitation. Funds credited to the trust fund consist of those

44

funds collected from the Temporary Assistance for Needy Families

45

Block Grant.

     2. In accordance with s. 19(f)(2), Art. III of the State

47

Constitution, the Welfare Transition Trust Fund shall be

48

terminated on July 1, 2008, unless terminated sooner. Before its

49

scheduled termination, the trust fund shall be reviewed as

50

provided in s. 215.3206(1) and (2).

     Section 3.  This act shall take effect July 1, 2008.
