An act relating to trust funds; re-creating the Water

Protection and Sustainability Program Trust Fund within

4

the Department of Environmental Protection without

5

modification; repealing s. 403.891(3), F.S.; abrogating

6

provisions relating to the termination of the trust fund,

7

to conform; providing an effective date.

     WHEREAS, the Legislature wishes to extend the life of the

10

Water Protection and Sustainability Program Trust Fund within the

11

Department of Environmental Protection, which is otherwise

12

scheduled to be terminated pursuant to constitutional mandate,

13

and

14

     WHEREAS, the Legislature has reviewed the trust fund before

15

its scheduled termination date and has found it continues to meet

16

an important public purpose, and

17

     WHEREAS, the Legislature has found that existing public

18

policy concerning the trust fund sets adequate parameters for

19

its use, NOW, THEREFORE,

Be It Enacted by the Legislature of the State of Florida:

     Section 1. The Water Protection and Sustainability Program

24

Trust Fund within the Department of Environmental Protection,

25

FLAIR number 37-2-2603, which is to be terminated pursuant to

26

Section 19(f), Article III of the State Constitution on July 1,

27

2009, is re-created.

     Section 2. Subsection (3) of section 403.891, Florida

29

Statutes, is repealed.

     Section 3.  This act shall take effect July 1, 2009.
