recommended the following amendment:

     Senate Amendment (with title amendment)

     Delete line(s) 34-43

and insert:

     Section 1. Subsections (3) and (4) of section 350.01,

8

Florida Statutes, are amended to read:

9

     350.01 Florida Public Service Commission; terms of

10

commissioners; vacancies; election and duties of chair; quorum;

11

proceedings.-

     (3)  Any person serving on the commission who seeks to be

13

appointed or reappointed shall file with the nominating council

14

no later than June 1 of the year in which his or her term expires

15

at least 210 days before the expiration of his or her term a

16

statement that he or she desires to serve an additional term.

17

     (4) One member of the commission shall be elected by

18

majority vote to serve as chair for a term of 2 years, beginning

19

on January 2 of the first year of the term with the first Tuesday

20

after the first Monday in January 1979. A member may not serve

21

two consecutive terms as chair.
