An act relating to the dispensing of drugs; creating s.

765.5225, F.S.; prohibiting a pharmacist from dispensing

4

an immunosuppressive drug following an organ transplant

5

which is not the specific formulation or manufactured by

6

the specific manufacturer as prescribed by the

7

practitioner; authorizing a pharmacist to substitute a

8

drug product that is generically equivalent to the

9

prescribed drug only upon obtaining written or oral

10

authorization from the prescribing practitioner; providing

11

an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 765.5225, Florida Statutes, is created

16

to read:

     765.5225 Preservation of donated organs.--

18

     (1) In order to promote the maintenance of donated organs,

19

a pharmacist may not dispense a drug for immunosuppressive

20

therapy following transplant which is not the specific

21

formulation or which is not manufactured by the specific

22

manufacturer as prescribed by the prescribing practitioner.

     (2) A pharmacist may substitute a drug product that is

24

generically equivalent to the drug prescribed for

25

immunosuppressive therapy following transplant only if, before

26

making the substitution, the pharmacist obtains written or oral

27

authorization from the prescribing practitioner.

     Section 2.  This act shall take effect upon becoming a law.
