An act relating to trust funds; creating the Lead

Poisoning Prevention Trust Fund within the Department of

4

Health; providing for a source of funds and purposes of

5

the trust fund; providing for an annual carryforward of

6

funds; providing for future review and termination or re-

7

creation of the trust fund; providing a contingent

8

effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. (1) The Lead Poisoning Prevention Trust Fund is

13

created within the Department of Health. Funds credited to the

14

trust fund shall consist of fees generated from examinations and

15

certification required under the Florida Lead-based Paint

16

Reduction Program pursuant to s. 381.99, Florida Statutes.

     (2) Notwithstanding s. 216.301, Florida Statutes, and

18

pursuant to s. 216.351, Florida Statutes, any balance in the

19

trust fund at the end of any fiscal year shall remain in the fund

20

and be available for carrying out the purposes of the trust fund.

     (3) In accordance with s. 19(f)(2), Art. III of the State

22

Constitution, the trust fund shall, unless terminated sooner, be

23

terminated on July 1, 2012. Before its scheduled termination, the

24

trust fund shall be reviewed as provided in s. 215.3206(1) and

25

(2), Florida Statutes.

     Section 2.  This act shall take effect July 1, 2008, if SB

27

____, or similar legislation is adopted in the same legislative

28

session or an extension thereof and becomes law.
