An act relating to trust funds; creating s. 445.061, F.S.;

creating the Florida Business and Workforce

Competitiveness Trust Fund within the Agency for Workforce

Innovation; providing for sources of funds and purposes;

providing for annual carryforward of funds; providing for

future review and termination or re-creation of the trust
8
fund; providing a contingent effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Section 445.061, Florida Statutes, is created to
13
read:

445.061 Florida Business and Workforce Competitiveness
15
Trust Fund.--
16
(1) The Florida Business and Workforce Competitiveness
17
Trust Fund is created within the Agency for Workforce Innovation
18
and shall be administered by the regional workforce boards, as
19
defined in s. 445.007, upon allocation by Workforce Florida, Inc.
20
Funds credited to the trust fund shall consist of employment
21
training investment assessments from employer contributions under
22
s. 443.131.

(2) The trust fund is established for use as a depository
24
for funds to be used for the purposes of the Florida Business and
25
Workforce Competitiveness Program established in s. 445.06.

any balance in the trust fund at the end of any fiscal year shall
28
remain in the trust fund at the end of the year and shall be
29
available for carrying out the purpose of the trust fund.

(4) In accordance with s. 19(f)(2), Art. III of the State
31
Constitution, the Florida Business and Workforce Competitiveness
32
Trust Fund shall, unless terminated sooner, be terminated on July
33
1, 2012. Before its scheduled termination, the trust fund shall
34
be reviewed as provided in s. 215.3206(1) and (2).

Section 2. This act shall take effect July 1, 2008, if
36
Senate Bill ___, or similar legislation, is adopted in the same
37
legislative session or an extension thereof and becomes law.
