5 | Section 8. Paragraph (v) of subsection (3) of section |
6 | 627.6699, Florida Statutes, is amended to read: |
7 | 627.6699 Employee Health Care Access Act.-- |
8 | (3) DEFINITIONS.--As used in this section, the term: |
9 | (v) "Small employer" means, in connection with a health |
10 | benefit plan with respect to a calendar year and a plan year, |
11 | any person, sole proprietor, self-employed individual, |
12 | independent contractor, firm, corporation, partnership, or |
13 | association that is actively engaged in business, has its |
14 | principal place of business in this state, employed an average |
15 | of at least 1 but not more than 50 eligible employees on |
16 | business days during the preceding calendar year, the majority |
17 | of whom were employed within this state, and employs at least 1 |
18 | employee on the first day of the plan year, and is not formed |
19 | primarily for purposes of purchasing health insurance. In |
20 | determining the number of eligible employees, companies that are |
21 | an affiliated group as defined in s. 1504(a) of the Internal |
22 | Revenue Code shall be considered one employer. For purposes of |
23 | this section, a sole proprietor, an independent contractor, or a |
24 | self-employed individual is considered a small employer only if |
25 | all of the conditions and criteria established in this section |
26 | are met. |
