     Section 2.  Present subsection (9) of section 403.087,

Florida Statutes, is redesignated as subsection (10), and a new

10

subsection (9) is added to that section, to read:

     403.087  Permits; general issuance; denial; revocation;

12

prohibition; penalty.--

     (9) For the purposes of evaluating any application for

14

construction or operation of a Class I landfill that is proposed

15

to be located in an area designated by rule as a water use

16

caution area by the appropriate water management district and

17

that is on or immediately adjacent to a Class III landfill

18

permitted before January 1, 1994, the term "household or

19

residential garbage" means those materials defined as solid waste

20

or white goods in s. 403.703. This subsection applies to all

21

applications submitted after January 1, 2006, for which the

22

department has not issued a final permit.
