          Section 2.  Present subsection (9) of section 403.087,

8

Florida Statutes, is redesignated as subsection (10) and a new

9

subsection (9) is added to read:

     403.087  Permits; general issuance; denial; revocation;

11

prohibition; penalty.--

12

     (9) For the purposes of evaluating any applications for

13

construction or operation of a Class I landfill that is proposed

14

to be located in an area designated, by rule, as a water use

15

caution area by the appropriate water management district and

16

that is on or immediately adjacent to a Class III landfill

17

permitted prior to January 1, 1994, the term household or

18

residential garbage shall mean those materials defined as solid

19

waste or white goods in s. 403.703. This act applies to all

20

applications submitted after January 1, 2006, for which the

21

department has not issued a final permit.
