An act relating to trust funds; creating the Reduced

Cigarette Ignition Propensity and Firefighter Protection

4

Enforcement Trust Fund within the Division of Alcoholic

5

Beverages and Tobacco of the Department of Business and

6

Professional Regulation; providing for a source of funds

7

and purpose of the trust fund; providing for an annual

8

carryforward of funds; providing for future review and

9

termination or re-creation of the trust fund; providing a

10

contingent effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. (1) The Reduced Cigarette Ignition Propensity

15

and Firefighter Protection Enforcement Trust Fund is created

16

within the Division of Alcoholic Beverages and Tobacco of the

17

Department of Business and Professional Regulation. Funds

18

credited to the trust fund shall consist of certification fees

19

submitted by cigarette manufacturers pursuant to s. 633.042,

20

Florida Statutes.

     (2) Notwithstanding s. 216.301, Florida Statutes, and

22

pursuant to s. 216.351, Florida Statutes, any balance in the

23

trust fund at the end of any fiscal year shall remain in the fund

24

and be available for carrying out the purposes of the trust fund.

     (3) In accordance with s. 19(f)(2), Art. III of the State

26

Constitution, the trust fund shall, unless terminated sooner, be

27

terminated on July 1, 2012. Before its scheduled termination, the

28

trust fund shall be reviewed as provided in s. 215.3206(1) and

29

(2), Florida Statutes.

     Section 2.  This act shall take effect July 1, 2008, if SB

31

____, or similar legislation is adopted in the same legislative

32

session or an extension thereof and becomes law.
