An act relating to trust funds; creating the Fire

Prevention and Public Safety Trust Fund within the

4

Department of Financial Services; providing for a source

5

of funds and purpose of the trust fund; providing for an

6

annual carryforward of funds; providing for future review

7

and termination or re-creation of the trust fund;

providing a contingent effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. (1) The Fire Prevention and Public Safety Trust

13

Fund is created within the Department of Financial Services.

Funds credited to the trust fund shall consist of all moneys

15

recovered as penalties under s. 633.042(5), Florida Statutes, and

16

shall be used for the purpose of supporting fire safety and

17

prevention programs.

     (2) Notwithstanding s. 216.301, Florida Statutes, and

19

pursuant to s. 216.351, Florida Statutes, any balance in the

20

trust fund at the end of any fiscal year shall remain in the fund

21

and be available for carrying out the purposes of the trust fund.

     (3) In accordance with s. 19(f)(2), Art. III of the State

23

Constitution, the trust fund shall, unless terminated sooner, be

24

terminated on July 1, 2012. Before its scheduled termination, the

25

trust fund shall be reviewed as provided in s. 215.3206(1) and

26

(2), Florida Statutes.

     Section 2.  This act shall take effect July 1, 2008, if SB

29

2640, or similar legislation is adopted in the same legislative

30

session or an extension thereof and becomes law.
