The Committee on Health Regulation (Jones) recommended the

following amendment:

     Delete line(s) 153-159

and insert: regulatory board. However, the agency or the

7

appropriate regulatory board shall make available, upon written

8

request by a health care professional against whom probable cause

9

has been found, any such records which form the basis of the

10

determination of probable cause. The agency may investigate, as

11

it deems appropriate, any such incident and prescribe measure

12

that must or may be taken in response to the incident. The agency

13

shall forward a copy of each incident report to the department.

14

The department shall determine whether it potentially involved

15

conduct by a health care professional who is subject to

16

disciplinary action, in which case the provisions of s. 456.073

17

shall apply. The agency shall
