     (3) The Department of Health shall:

8

     (a) By January 1, 2009, submit a plan for approval by the

9

United States Department of Agriculture, Bureau of Food and

10

Nutrition Service, for the implementation of a statewide

11

electronic benefits transfer program for the dissemination of

12

benefits under the Special Supplemental Nutrition Program for

13

Women, Infants, and Children (WIC), authorized by the Child

14

Nutrition Act. The plan shall be developed in consultation with

15

WIC vendors, including above-50-percent vendors.

16

     (b) By July 1, 2010, establish a statewide electronic

17

benefit transfer program for the dissemination of benefits under

18

the Special Supplemental Nutrition Program for Women, Infants,

19

and Children (WIC), authorized by the Child Nutrition Act. The

20

electronic benefit transfer program shall be implemented in

21

consultation with WIC vendors, including above-50-percent

22

vendors.

     (c) Submit reports to the Speaker of the House and the

24

President of the Senate as to progress in obtaining federal

25

approval and establishing a statewide electronic benefit transfer

26

system by January 1, 2009, and by January 1, 2010.

     Section 2.  Subsection (3) is added to section 383.011,

28

Florida Statutes, to read:

29

     383.011  Administration of maternal and child health

30

programs.--

31

     (3) In administering the WIC program, the Department of

32

Health:

33

     (a) Upon implementation of an electronic benefit transfer

34

system and for the purposes of meeting the federal cost

35

neutrality requirement of 7 C.F.R. part 246, shall compare the

36

average cost of each food item redeemed by above-50-percent

37

vendors against the average cost of the same food item redeemed

38

by regular vendors. The department shall collect individual food

39

item redemption costs by requiring authorized vendors to record

40

the price of each redeemed item on the WIC voucher.

41

     (b) May not discontinue a WIC-eligible generic product

42

unless the product no longer meets the nutritional guidelines of

43

the WIC program.
