The Committee on Governmental Operations (Lawson) recommended the

following amendment to amendment (223292):

insert:

     Section 13.  Subsection (4) is added to section 272.129,

8

Florida Statutes, to read:

9

     272.129  Florida Historic Capitol; space allocation;

10

maintenance, repair, and security.--

11

     (4)(a) The Legislative Research Center and Museum at the

12

Historic Capitol, hereinafter referred to as "center," may

13

support the establishment of a citizen support organization to

14

provide assistance, funding, and promotional support for the

15

center. For the purposes of this subsection, "citizen support

16

organization" means an organization that is:

17

     1. A Florida corporation not for profit incorporated under

18

the provisions of chapter 617 and approved by the Department of

19

State.

20

     2. Organized and operated to conduct programs and

21

activities, raise funds, request and receive grants, gifts, and

22

bequests of money, acquire, receive, hold, invest, and administer

23

in its own name securities, funds, objects of value, or other

24

real and personal property, and make expenditures to or for the

25

direct or indirect benefit of the center.

26

     3. Determined by the center to be consistent with the goals

27

of the center and in the best interests of the state.

28

     4. Annually approved in writing by the center to operate

29

for the direct or indirect benefit of the center. Such approval

30

shall be given in a letter of agreement from the center.

31

     (b)1. The Legislative Research Center and Museum at the

32

Historic Capitol may permit, without charge, appropriate use of

33

fixed property and facilities of the center by the citizen

34

support organization, subject to the provisions of this

35

subsection. Such use must be directly in keeping with the

36

approved purposes of the citizen support organization and may not

37

be made at times or places that would unreasonably interfere with

38

normal operations of the center.

     2. The center may prescribe by rule any condition with

40

which the citizen support organization must comply in order to

41

use fixed property or facilities of the center.

42

     3. The center may not permit the use of any fixed property

43

or facilities by any citizen support organization if such

44

organization does not provide equal membership and employment

45

opportunities to all persons regardless of race, color, religion,

46

sex, age, or national origin.

47

     (c) A citizen support organization shall provide for an

48

annual financial audit in accordance with s. 215.981.

49

     (d) All records of a citizen support organization

50

constitute public records for the purposes of chapter 119.

51

     (e) The citizen support organization for the Legislative

52

Research Center and Museum at the Historic Capitol is authorized

53

to collect rental fees, apply for and receive grants, and receive

54

gifts and donations for the direct or indirect benefit of the

55

center.

     (f) All funds obtained through rental fees, grants, gifts,

57

and donations to the citizen support organization shall be

58

deposited into the account of the citizen support organization

59

and used for the direct or indirect benefit of the Legislative

60

Research Center and Museum at the Historic Capitol unless the

61

citizen support organization is no longer authorized as required

62

by this subsection, fails to comply with the requirements of this

63

subsection, fails to maintain its tax-exempt status pursuant to

64

Section 501 (c)(3) of the Internal Revenue Code, or ceases to

65

exist. If the citizen support organization is no longer

66

authorized as required by this subsection, fails to comply with

67

the requirements of this subsection, fails to maintain its tax-

68

exempt status pursuant to Section 501 (c)(3) of the Internal

69

Revenue Code, or ceases to exist, all funds obtained through

70

rental fees, grants, gifts, and donations in the citizen support

71

organization account shall revert to the state and be deposited

72

into an account designated by the Florida Legislature.

And the title is amended as follows:

     On line 522, after the semicolon,

insert:

authorizing a citizen support organization for the

Legislative Research Center and Museum at the Historic

Capitol; requiring the citizen support organization to be

a corporation not for profit; authorizing the citizen

82

support organization to perform certain tasks for the

83

direct and indirect benefit of the Legislative Research

84

Center and Museum at the Historic Capitol; authorizing the

85

center to prescribe conditions with which the citizen

86

support organization must comply in order to use fixed

87

property or facilities of the center; prohibiting the

88

center from permitting a citizen support organization to

89

use the center's facilities under certain conditions;

90

requiring that the citizen support organization provide

91

for an annual audit; providing that records of the

92

organization are public records; requiring that certain

93

funds be deposited into the account of the citizen support

94

organization; providing for reversion of funds to the

95

state under certain circumstances;
