3     Amendment (with title amendment)
4     Between lines 361 and 362, insert:
5     Section 3.  Paragraph (i) of subsection (4) of section
6400.9905, Florida Statutes, is amended to read:
7     400.9905  Definitions.--
8     (4)  "Clinic" means an entity at which health care services
9are provided to individuals and which tenders charges for
10reimbursement for such services, including a mobile clinic and a
11portable equipment provider. For purposes of this part, the term
12does not include and the licensure requirements of this part do
13not apply to:
14     (i)  Entities that provide only oncology or radiation
15therapy services by physicians licensed under chapter 458 or
16chapter 459, or entities that provide oncology or radiation
17therapy services by physicians licensed under chapter 458 or
18chapter 459 which are owned by a corporation whose shares are
19publicly traded on a recognized stock exchange, or entities that
20provide oncology or radiation therapy services, whether at a
21single location or multiple locations, by or under the
22supervision of physicians licensed under chapter 458 or chapter
23459, where the entity derives more than 50 percent of its total
24revenues from those services.

28     Remove line 9 and insert:
29Criminal Punishment Code; amending s. 400.9905, F.S.; redefining
30the term "clinic" for purposes of the Health Care Clinic Act to
31exclude from coverage under the act those entities deriving a
32certain percentage of gross annual revenue from oncology
33services or radiation therapy; providing an effective date.
