2An act relating to false and fraudulent insurance claims;
3amending s. 817.234, F.S.; providing penalties for
4specified insurance fraud violations involving personal
5injury protection insurance; providing for professional
6license suspensions for certain health care practitioners
7convicted of such violations; amending s. 921.0022, F.S.;
8conforming the offense severity ranking chart of the
9Criminal Punishment Code; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Subsections (2), (11), and (12) of section
14817.234, Florida Statutes, are amended to read:
15     817.234  False and fraudulent insurance claims.--
16     (2)(a)  Any physician licensed under chapter 458,
17osteopathic physician licensed under chapter 459, chiropractic
18physician licensed under chapter 460, or other practitioner
19licensed under the laws of this state who knowingly and
20willfully assists, conspires with, or urges any insured party to
21fraudulently violate any of the provisions of this section or
22part XI of chapter 627, or any person who, due to such
23assistance, conspiracy, or urging by said physician, osteopathic
24physician, chiropractic physician, or practitioner, knowingly
25and willfully benefits from the proceeds derived from the use of
26such fraud, commits insurance fraud, punishable as provided in
27subsection (11). In the event that a physician, osteopathic
28physician, chiropractic physician, or practitioner is
29adjudicated guilty of a violation of this section, the Board of
30Medicine as set forth in chapter 458, the Board of Osteopathic
31Medicine as set forth in chapter 459, the Board of Chiropractic
32Medicine as set forth in chapter 460, or other appropriate
33licensing authority shall hold an administrative hearing to
34consider the imposition of administrative sanctions as provided
35by law against said physician, osteopathic physician,
36chiropractic physician, or practitioner.
37     (b)  In the event that a physician licensed under chapter
38458, an osteopathic physician licensed under chapter 459, a
39chiropractic physician licensed under chapter 460, or other
40practitioner licensed under the laws of this state is convicted
41of insurance fraud that involves a claim for personal injury
42protection benefits as required by s. 627.736, the Board of
43Medicine as set forth in chapter 458, the Board of Osteopathic
44Medicine as set forth in chapter 459, the Board of Chiropractic
45Medicine as set forth in chapter 460, or other appropriate
46licensing authority shall, in addition to any other punishment
47less than revocation or relinquishment of the license, suspend
48the license of such physician, osteopathic physician,
49chiropractic physician, or practitioner for 12 months.
50     (c)(b)  In addition to any other provision of law,
51systematic upcoding by a provider, as defined in s. 641.19(14),
52with the intent to obtain reimbursement otherwise not due from
53an insurer is punishable as provided in s. 641.52(5).
54     (11)(a)  If the value of any property involved in a
55violation of this section:
56     1.(a)  Is less than $20,000, the offender commits a felony
57of the third degree, punishable as provided in s. 775.082, s.
58775.083, or s. 775.084.
59     2.(b)  Is $20,000 or more, but less than $100,000, the
60offender commits a felony of the second degree, punishable as
61provided in s. 775.082, s. 775.083, or s. 775.084.
62     3.(c)  Is $100,000 or more, the offender commits a felony
63of the first degree, punishable as provided in s. 775.082, s.
64775.083, or s. 775.084.
65     (b)  Notwithstanding any other provision of law, any person
66who is convicted of insurance fraud that involves a claim for
67personal injury protection benefits as required by s. 627.736:
68     1.  Commits a felony of the second degree, punishable as
69provided by s. 775.082 and by a fine of $200,000.
70     2.  A second or subsequent time commits a felony of the
71second degree, punishable as provided by s. 755.082 and by a
72fine of $500,000.
73     (12)  As used in this section:
74     (a)  "Conviction" has the same meaning as provided in s.
75775.0837.
76     (b)(a)  "Property" means property as defined in s. 812.012.
77     (c)(b)  "Value" means value as defined in s. 812.012.
