     Between lines 79 and 80,

insert:

     Section 2.  Paragraph (d) of subsection (5) of section

8

288.1162, Florida Statutes, is amended to read:

9

     288.1162  Professional sports franchises; spring training

10

franchises; duties.--

11

     (5)

     (d)  Funds may not be expended to subsidize privately owned

13

and maintained facilities for use by the spring training

14

franchise. Funds may be used to relocate a retained spring

15

training franchise to another unit of local government upon

16

approval of the Office of Tourism, Trade, and Economic

17

Development. The office shall establish criteria for use of the

18

funds to relocate a retained spring training franchise consistent

19

with the requirements of this section only if the existing unit

20

of local government with the retained spring training franchise

21

agrees to the relocation. A spring training franchise that is

22

eligible for a sales tax refund pursuant to s. 212.20 and that

23

relocates from one community in this state to another community

24

may not receive more than 90 percent of the refund. The office

25

may adopt rules pursuant to ss. 120.536(1) and 120.54 to

26

administer this section.

     Section 3. On or before December 31, 2008, the Office of

28

Tourism, Trade, and Economic Development shall develop a

29

comprehensive strategic plan, including the use of financial

30

resources, for the purpose of retaining the tradition of spring

31

training in Florida. Such plan shall identify the financial

32

impact spring training has on this state and identify efforts

33

made by other states to organize spring training efforts and the

34

effects of those efforts on Florida's relationship with

35

professional baseball.

insert:

amending s. 288.1162, F.S.; authorizing the use of certain

42

funds to relocate a retained spring training franchise to

43

another unit of local government upon approval of the

44

Office of Tourism, Trade, and Economic Development;

45

requiring that the office establish criteria for the use

46

of such funds; limiting the amount of a certain sales tax

47

refund that may be received by a spring training franchise

48

relocating from one community in Florida to another;

49

authorizing the office to adopt rules; requiring that the

50

office develop a comprehensive strategic plan for the

51

purpose of retaining the tradition of spring training in

52

Florida; requiring that such plan identify certain

53

information;
