An act relating to professional engineer liability;

creating s. 768.1346, F.S.; precluding malpractice claims

4

against licensed professional engineers who provide

5

certain services without compensation to search and rescue

6

teams during declared emergencies if certain conditions

7

are met; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 768.1346, Florida Statutes, is created

12

to read:

     768.1346 Professional malpractice; rescue structures

14

specialist immunity.--No person shall have a claim for

15

professional malpractice against a licensed professional engineer

16

who provides services without compensation to a local, state, or

17

federal search and rescue team during the period of a declared

18

emergency if the professional services arouse out of the

19

emergency and the professional acted as an ordinary reasonably

20

prudent member of the profession would have acted under the same

21

or similar circumstances.

     Section 2.  This act shall take effect July 1, 2008.
