A bill to be entitled

An act relating to the immigration status of inmates;

3

amending ss. 944.17 and 951.23, F.S.; requiring the

4

Department of Corrections and the administrator of each

5

county or municipal detention facility to train personnel

6

processing inmates in identification of false or

7

fraudulent immigration status documentation and other

8

indicators of illegal presence in the United States;

9

requiring examination of each incoming inmate's

10

immigration status; requiring notification of federal

11

officials whenever it is suspected that an inmate is not

12

in the country legally; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

15

     Section 1.  Subsection (9) is added to section 944.17,

17

Florida Statutes, to read:

18

     944.17  Commitments and classification; transfers.--

19

     (9) The department shall train appropriate personnel

20

involved in processing inmates committed to its custody in

21

identification of false or fraudulent immigration status

22

documentation and other indicators of illegal presence in the

23

United States. The department shall examine the immigration

24

status of each person committed to its custody and shall notify

25

appropriate federal officials whenever it suspects that such a

26

person is not legally present in the United States.

     Section 2.  Subsection (11) is added to section 951.23,

28

Florida Statutes, to read:

29

     951.23  County and municipal detention facilities;

30

definitions; administration; standards and requirements.--

31

     (11) The administrator of each county or municipal

32

detention facility shall train appropriate personnel involved in

33

processing inmates committed to the custody of that facility in

34

identification of false or fraudulent immigration status

35

documentation and other indicators of illegal presence in the

36

United States. The administrator of each county or municipal

37

detention facility shall examine the immigration status of each

38

person committed to the custody of that facility and shall notify

39

appropriate federal officials whenever it suspects that such a

40

person is not legally present in the United States.

     Section 3.  This act shall take effect July 1, 2008.
