1Representative Attkisson offered the following:

3     Amendment to Amendment (197813) (with title amendment)
4     Between lines 1049 and 1050, insert:
5     (d)1.  For purposes of this paragraph, the term "member"
6means a person who:
7     a.  Retired from employment with an employer;
8     b.  Was a member of the Senior Management Service Class or
9was a member of the Special Risk Class and held the rank or
10equivalent rank of captain or above, upon retirement or at the
11end of DROP participation; and
12     c.  Was reemployed during months 2 through 12 by the same
13employer from which the member retired.
14     2.  For the period July 1, 2005, to June 30, 2008, any
15employer who reemployed a member in months 2 through 12 of
16retirement must certify to the Governor, the President of the
17Senate, and the Speaker of the House of Representatives the
18following information on each reemployed member no later than
19October 1, 2008:
20     a.  The date the member notified the employer that he or
21she intended to retire or enter DROP.
22     b.  The date the member provided as his or her date for
23retirement or DROP participation dates.
24     c.  How much time the employer had to plan for that
25member's upcoming retirement and to recruit and train a person
26to take over the member's job responsibilities prior to that
27member's retirement date.
28     d.  Why the employer failed to plan for that member's
29upcoming retirement and to recruit and train another person to
30take over the member's job responsibilities prior to that
31member's retirement date.
32     3.  On or after July 1, 2008, any employer who reemploys a
33member in months 2 through 12 of retirement must certify to the
34Governor, the President of the Senate, and the Speaker of the
35House of Representatives the following information on each
36reemployed member within 30 days of reemployment:
37     a.  The date the member notified the employer that he or
38she intended to retire or enter DROP.
39     b.  The date the member provided as his or her date for
40retirement or DROP participation dates.
41     c.  How much time the employer had to plan for that
42member's upcoming retirement and to recruit and train a person
43to take over the member's job responsibilities prior to that
44member's retirement date.
45     d.  Why the employer failed to plan for that member's
46upcoming retirement and to recruit and train another person to
47take over the member's job responsibilities prior to that
48member's retirement date.

53Deferred Retirement Option Program; defining the term "member"
54for purposes of reporting to the Governor, the President of the
55Senate, and the Speaker of the House of Representatives those
56members who have been reemployed after retirement; requiring
57employers to certify to the Governor, the President of the
58Senate, and the Speaker of the House of Representatives
59information regarding those employers who reemployed members
60during months 2 through 12 of retirement; prohibiting certain
