An act relating to specialty license plates; amending ss.

license plate; establishing an annual use fee for the

plate; providing for the distribution of use fees received
6
from the sale of such plates; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Paragraph (mmm) is added to subsection (4) of
11
section 320.08056, Florida Statutes, to read:
12
320.08056 Specialty license plates.--
13
(4) The following license plate annual use fees shall be
14
collected for the appropriate specialty license plates:
15
(mmm) In God We Trust license plate, $25.
16
Section 2. Subsection (65) is added to section 320.08058,
17
Florida Statutes, to read:

320.08058 Specialty license plates.--

(65) In God We Trust LICENSE PLATES.--

(a) The department shall develop an In God We Trust license
21
plate as provided in this section. In God We Trust license plates
22
must bear the colors and design approved by the department. The
23
word "Florida" must appear at the top of the plate, and the words
24
"In God We Trust" must appear in the body of the plate.

(b) The license plate annual use fees shall be distributed
26
to In God We Trust Foundation, Inc., to fund educational
27
scholarships for the children of Florida residents who are
28
members of the United States Armed Forces, the National Guard,
29
and the United States Armed Forces Reserve and for the children
30
of public safety employees who have died in the line of duty who
31
are not covered by existing state law. Funds shall also be
32
distributed to other 501(c)(3) organizations that may apply for
33
grants and scholarships and to provide educational grants to
34
public and private schools to promote the historical and
35
religious significance of American and Florida history. In God We
36
Trust Foundation, Inc., shall distribute the license plate annual
37
use fees in the following manner:

1. In God We Trust Foundation, Inc., shall retain all
39
revenues from the sale of such plates until all startup costs for
40
developing and establishing the plate have been recovered.

2. Twenty-five percent of the funds received by In God We
42
Trust Foundation, Inc., shall be expended for administrative
43
costs, promotion, and marketing of the license plate directly
44
associated with the operations of In God We Trust Foundation,
45
Inc.

3. All remaining funds shall be expended by In God We Trust
47
Foundation, Inc., for programs.

Section 3. This act shall take effect July 1, 2008.
