     Delete lines 617-629

and insert:

     (2)  Any person who violates any provision of this part

7

shall be subject to a fine in an amount not greater than $5,000

8

$2,500 for each nonwillful violation and not greater than $40,000

9

$20,000 for each willful violation. Fines under this subsection

10

may not exceed an aggregate amount of $20,000 $10,000 for all

11

nonwillful violations arising out of the same action or an

12

aggregate amount of $200,000 $100,000 for all willful violations

13

arising out of the same action. The fines authorized by this

14

subsection may be imposed in addition to any other applicable

15

penalty.
