An act relating to the practice of medicine; creating s.

458.3096, F.S.; prohibiting medical residency, licensure,

or practice under certain circumstances; providing an

exception; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 458.3096, Florida Statutes, is created

10

to read:

     458.3096 Prohibition of medical residency, licensure, or

12

practice in the state; grounds for prohibition; exception.--

13

     (1) Notwithstanding any other provision of law to the

14

contrary, any United States citizen or United States resident who

15

travels to Cuba to receive medical training or a medical degree

16

is prohibited from undertaking his or her medical residency in

17

the state, from being licensed to practice medicine in the state,

18

and from practicing medicine in any capacity in the state.

19

     (2) This prohibition does not apply to any native or

20

citizen of Cuba who received his or her medical training or

21

medical degree in Cuba prior to immigrating to the United States.

22

     Section 2.  This act shall take effect July 1, 2008.
